A trial date has been set in February for the disgraced former president of the Spanish Football Federation (RFEF), Luis Rubiales, for his unsolicited kiss on the lips of Women’s World Cup winner Jenni Hermoso, the court overseeing the process said on Monday.

西足總蒙羞的前主席Luis Rubiales，因為對女足世界盃冠軍球員Jenni Hermoso不請自來的嘴對嘴親吻的官司訴訟被底定在二月了，本週一審理法院表示。

Rubiales, 46, provoked worldwide outrage by kissing Hermoso during the medal ceremony after Spain beat England to win the World Cup in Australia last year.

46歲的Rubiales，在女子世足決賽西班牙擊敗英格蘭的授獎典禮強吻了Hermoso女士，引發了全世界的震怒。

In May a court had ruled Rubiales should be tried for sexual assault over the kiss, and for the alleged coercion subsequently exerted to make her say that it was consensual, without setting a date.

五月法庭裁定了Rubiales應該要試著以被強吻的性騷擾罪，與涉嫌隨後施壓，迫使她發出聲明表示這是雙方合意的吻受審。但並沒有訂下審判日。

The trial will be held at the Audiencia Nacional, a Madrid court in charge of complex cases, from 3-19 February, the court said in a statement.

這次的審判將會於2月3號到19號，在馬德里的國家法院—負責受理複雜案件的馬德里法庭—舉行，法庭在聲明中表示。

Public prosecutors have requested a sentence of two-and-a-half years in prison for Rubiales – one year for sexual assault and 18 months for coercion.

檢察官已經要求對Rubiales判決兩年半的有期徒刑——性騷罪一年，並且在脅迫罪要求18個月刑期。

The prosecution is also asking for two years’ probation once the sentence has been served and for him to pay €50,000 in compensation to the player.

除此之外，檢察官也要求在判決確定後兩年的緩刑期，並且付予五萬歐元給球員作為補償金。

Rubiales, who is also under investigation in a separate alleged corruption case involving his reign at the federation, has denied any wrongdoing.

Three of his former associates are also being tried for putting pressure on Hermoso: former women’s coach Jorge Vilda, men’s team director Albert Luque and federation marketing boss Ruben Rivera.

The kiss took place live in front of the world’s cameras, provoking widespread outrage and prompting his suspension by world football governing body FIFA.

At the time, Rubiales brushed it off as ‘a consensual’ peck on the lips, but Hermoso, 34, said it was not.

Under Spanish law, a non-consensual kiss can be classed as sexual assault – a criminal category that groups all types of sexual violence.

在西班牙法律下，一個未經雙方同意的吻可以被視作性騷擾—一種囊括各種性暴力的犯罪類別。

Rubiales told private Spanish television station La Sexta in April that he could not understand how the kiss he gave Hermoso could be labelled as sexual assault, saying there was ‘no sexual context’ to it.

今年四月，Rubiales跟西班牙私營電視台La Sexta表示，他不理解為什麼他給Hermoso的吻會被當成性騷擾，表示那個吻「沒有性意味」藏於其中。 

He denied accusations that he and other federation officials coerced Hermoso by pressuring her to speak out in his defence after the scandal erupted.

他也否認了他或其他西足總官員，有透過逼著Hermoso在醜聞公諸於世後，要她為他發聲護航的脅迫指控。

‘I have a clear conscience, things have been blown out of proportion,’ Rubiales said.

Hermoso filed a lawsuit against Rubiales in September, telling the judge she had come under pressure to defend him both on the flight back from Australia and on a subsequent team holiday to Ibiza in the Balearic Islands. 

去年九月Hermoso出庭對質Rubiales，與庭上說明她是受壓，才在澳洲回程的飛機上跟隨後在球隊休息日去巴里阿里群島的伊比薩島，出面護衛Rubiales的名聲。

The former president of the Spanish Football Federation (RFEF), Luis Rubiales, has denied any wrongdoing while being questioned by an investigating judge as part of her probe into alleged corruption related to staging the Spanish Super Cup in Saudi Arabia.

西足總前主席Luis Rubiales，否認了在審判調查時，發現了關於在沙烏地阿拉伯舉辦的西班牙超級盃協議部分涉嫌貪腐之爭議，有任何錯誤的行為。

After hearing his testimony on Monday, the judge ordered Rubiales to appear once a month in person at the courthouse and to ask the court for permission if he wants to leave the country.

在週一的聽證會後，法庭命令Rubiales要一個月出庭一次，並且若想要離境需要經過法庭准許。

‘I am convinced that justice will be served,’ Rubiales told reporters after four hours inside the Madrid court. ‘Never was any money exchanging hands in an irregular manner.’

Rubiales stepped down as president of the RFEF in September after causing an international scandal after kissing Spain player Jenni Hermoso without her consent at the Women’s World Cup final. He is facing a separate trial over that incident after being accused of sexual assault but has also denied any wrongdoing in that case.

In the case related to the Super Cup, Rubiales was arrested earlier this month on his return from the Dominican Republic but was quickly released while remaining under investigation.

During his time as president of Spanish football, Rubiales overhauled the format of the Spanish Super Cup in 2020, creating a four-team mini tournament and moving the competition to Saudi Arabia as part of a deal that was reportedly worth €40 million per tournament for the federation.

Prosecutors opened a probe of that deal in 2022 following leaked audio between Rubiales and then-Barcelona player Gerard Piqué regarding millions of dollars in commissions.

The probe is investigating other officials and workers at the federation, including Rubiales successor, Pedro Rocha.

The judge issued an order to freeze assets in a bank account belonging to a company owned by Piqué. Piqué is not under official investigation.

Spain’s governmental sports authority said last week that it was stepping in to supervise the federation to protect the reputation of Spanish football. Spain is set to co-host the 2030 men’s World Cup with Portugal and Morocco.
